Another thing to consider is that in New Jersey, a business that offers health insurance to employees must pay at least 10% of the total group premiums. The employees who choose to participate would pay the balance of the premiums. Insurance carriers may require 75% participation among eligible employees, but this requirement is waived during the Employer Open Enrollment Period. As a rule of thumb, "eligible employees" are non-union workers putting in 25 hours or more per week. And generally, if an eligible employee is covered as a dependent on a spouse's or parent's employer-sponsored plan, then that employee still counts in your favor towards the 75% participation requirement (this is known as a "waiver").

For New Jersey-based businesses, all you need to qualify as a group is two employees (including the business owner) who are not married to each other. A husband and wife who own a business together would not be enough to qualify as a group unless there was at least one other eligible employee.
